Delhi High Court Intervenes in Recruitment Process
New Delhi: In a significant ruling, the Delhi High Court on Monday stayed a contentious advertisement that invited only retired prosecutors to apply for 196 public prosecutor vacancies. The court’s decision came in response to a petition challenging the advertisement, with a single-judge bench, presided over by Justice Sachin Dutta, stating that it was “unacceptable and regrettable” that young lawyers were being denied the opportunity to compete for the positions.
Court Issues Notices to Key Officials
The court has issued notices to the director of prosecution, the chief secretary, the principal secretary (home) of the Delhi government, and the Union Public Service Commission (UPSC), directing them to file their responses to the petition within two weeks. The matter has been scheduled for a hearing in October. The bench emphasized that the advertisement would remain in “abeyance” until a reasoned order is passed.
Petition Claims Bypassed Recruitment Process
The petition argues that the advertisement bypassed the established recruitment process for these positions. Senior advocate Mohit Mathur contended before the court that neither the director of prosecution nor the Delhi government had the authority to issue such an advertisement. This legal challenge underscores the growing concern among young legal professionals regarding fair access to government jobs. 1
